PPP Market Sounding on Behalf of Vietnam's Ministry of Planning and Investment

Hogan Lovells is pleased to support Vietnam's Ministry of Planning and Investment ("MPI"), who is organizing an investor conference/market sounding to introduce and discuss substantial draft revisions to Decision 71 (covering Vietnam's PPP program) and the related PPP tender procedures in the draft Law on Public Procurement. MPI has been charged with revising Decision 71 and developing related PPP provisions in the draft Law on Public Procurement to reenergize Vietnam's PPP program. To this end, Hogan Lovells has assisted MPI to significantly upgrade these regulations in a manner calculated to address issues that have to date hindered the development of PPP in Vietnam. These revised regulations are expected to go before the Prime Minister over the coming three months.

The MPI seeks comments from private sector players regarding these draft regulations in order to take into consideration private sector concerns regarding PPP in Vietnam and to ensure Vietnam’s PPP approach will work for both the public and private sectors. This feedback will be very important to help the Government of Vietnam understand the private sector viewpoint as it finalizes these regulations.

The market sounding will be held in each of Hanoi, Ho Chi Minh City and Singapore to give invitees the best chance to attend this important dialogue.

Agenda: The regulations are currently being prepared for public review. Prior to the first event in Hanoi, we will issue the draft regulations to confirmed attendees. We aim to give participants as much notice as possible before these events. Each event will generally be a half day session where the key provisions of the regulations will be presented and explained. Participants will be encouraged to provide open and frank comments on the draft regulations during the session and written comments are also most welcome.

Note: A special session in Hanoi during March or April will be later announced to members of the legal and consulting community to obtain focused feedback from the consultant community.
